GoPhysics owns and operate this Website. This document governs your relationship with https://www.gophysics.co.uk/ (“Website”). Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms & Conditions"). By using the Services, you are agreeing to all of the Terms & Conditions, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms & Conditions.
We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.
This Website may contain links to other websites (the "Linked Sites"), which are not operated by GoPhysics. GoPhysics has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site.

All such rights are reserved by GoPhysics and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
Eligibility
GoPhysics consists of two sections: a public area and a member's area.
The member's area is a paid access section where intellectual information is shared with course purchasers and license holders. No information from this section may be shared with those who have not purchased a license. Unless a Teacher license has been purchased, where content may be shared while the Teacher license holder is present Purchasers of licenses may buy them on behalf of a third party (e.g., a parent or guardian for their child) provided they do not intend to use the course for their own learning.
The public area of GoPhysics can be shared through links to the GoPhysics website. Content may not be used externally from the site, such as printing and using content externally. All content on GoPhysics, in both the public and member's area, is intellectual property and copying it for external use violates copyright.
When signing up you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to pay for services . Users must be 13 years and older to use the GoPhysics service. GoPhysics retains the right to refuse any request made by you. Users who violate GoPhysics policies may have their accounts revoked without a refund issued.
Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur.
Use of Content
Users must use GoPhysics content through the website unless they have purchased licensed course assets (e.g., Go Flash Cards and printable worksheets).
Physically printed content may only be used by a license holder and is not for resale, which would violate intellectual property copyright.
Physically printed content may only be used while the license holder’s subscription is active.
Support and Tutor Response
GoPhysics aims to provide comprehensive support to its users. As part of our service, we offer a tutor response feature where students can submit questions via email for clarification on GCSE Physics topics covered by our resources.
Please note the following regarding this service:
Discretionary Service: The tutor response service is provided at the discretion of GoPhysics and its designated tutors. While we endeavour to respond to all appropriate questions in a timely manner, we do not guarantee response times.
Availability: This service is contingent upon the availability of the tutor(s) providing this support. In the unforeseen event that the designated tutor(s) become unavailable due to illness, death, or other circumstances that prevent them from providing this service, GoPhysics may, at its sole discretion, modify, suspend, or discontinue the tutor response feature without prior notice.
Scope: The tutor response service is intended for clarification on existing GoPhysics content and relevant GCSE Physics specification content related questions.
Events Beyond Reasonable Control
We are not in breach of this Agreement or liable to you if there is a failure of performance resulting from a circumstance or event that is beyond our reasonable control. This includes natural disaster, fire, act of government or state regulation, war, terrorism, inability to communicate with a Third Party, failure of a computer or technological difficulty, failure of delay in transmission of digital files or communications, failure of any interest service provider, strike or industrial action that is beyond our reasonable control.
Definition of "Lifetime" Access
When you purchase "Lifetime Access" to GoPhysics resources, you are acquiring the right to access the specified content and features for the operational duration of the GoPhysics service, subject to the terms and conditions outlined herein.
1. Operational Duration of GoPhysics: "Lifetime Access" is defined as the period during which GoPhysics continues to operate and provide its services. This period is inherently uncertain and is dependent upon various factors, including, but not limited to:
Continued Viability: The ability of GoPhysics to remain financially viable and technically operational.
Platform Availability: The continued availability and suitability of third-party hosting platforms, such as Squarespace, used by GoPhysics. Should GoPhysics need to migrate to a different platform, we will endeavour to ensure continued access, but this may require technical adjustments or may be subject to the terms of the new platform.
Technical Feasibility: The ongoing technical feasibility of maintaining and delivering the resources, including compatibility with evolving web standards and technologies.
2. No Guaranteed Minimum Period: While we intend to provide GoPhysics services for as long as reasonably possible, "Lifetime Access" does not guarantee a minimum number of years or a specific duration. The service may cease to operate due to unforeseen circumstances, including, but not limited to:
Cessation of Operations: Should GoPhysics, for any reason, decide to cease its operations.
Acquisition or Merger: In the event that GoPhysics is acquired by or merges with another entity, the terms of access may be subject to the policies of the new entity.
Force Majeure: Events beyond our reasonable control (e.g., natural disasters, widespread internet outages, governmental actions).
3. Typical Understanding of "Lifetime": In the context of digital products and services, "lifetime" typically refers to the expected commercial lifespan of the product or service itself, rather than the lifetime of the purchaser. While it is our goal to provide long-term access, users should understand that this is not an indefinite guarantee extending beyond the operational life of GoPhysics.
4. Changes to Terms: GoPhysics reserves the right to modify or update these terms and conditions, including the definition of "Lifetime Access," at any time. We will endeavor to provide reasonable notice of any significant changes.
5. Exclusions: "Lifetime Access" specifically refers to access to the existing content and features available at the time of purchase, and any future updates or additions that GoPhysics, at its sole discretion, chooses to include within the "Lifetime Access" offering. It does not include:
Access to any new, distinct products or services that GoPhysics may launch in the future and offer separately.
Personalised tutoring, one-on-one support beyond general technical assistance, or other services explicitly defined as separate offerings.
By purchasing "Lifetime Access," you acknowledge and agree to these terms.
Disclaimer of Liability
The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law GoPhysics and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

Invalidity
If any part of the Terms & Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms & Conditions will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
Complaints
We operate a complaint handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.
Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Governing Law/Jurisdiction
These terms and conditions and the transactions contemplated hereby shall be governed by, and construed and interpreted in accordance with, the laws of the United Kingdom. Any action seeking legal or equitable relief arising out of or relating to these Terms will be brought only in the courts of the United Kingdom.
Entire Agreement
The above Terms & Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and GoPhysics. Any waiver of any provision of the Terms & Conditions will be effective only if in writing and signed by a Director of GoPhysics.
